This Refund Policy explains when users of Spayo (https://www.spayo.xyz and https://app.spayo.xyz) are eligible to receive a refund for payments made to the service. Spayo is operated by:

Because Spayo provides instant AI-generated digital content and token-based usage, refund rules differ from standard e-commerce policies.
1. Nature of the Service — Digital Goods
Spayo provides access to AI image processing, redesigns, and generation features.
All features are delivered digitally, instantly or near-instantly.
Under EU law (Directive 2011/83/EU), CH, UK, and US consumer protection rules:
- Digital goods delivered immediately are not subject to the standard 14-day right of withdrawal once the service has begun with the consumer’s consent.
- By purchasing a token package or by generating an AI design, the user agrees that the digital service begins immediately and waives the statutory withdrawal right.
2. Refund Eligibility
A refund may be granted only in the following circumstances:
2.1. Duplicate Payments
If a user was charged twice for the same purchase, Spayo will refund the duplicate charge.
2.2. Technical Errors Clearly Caused by Spayo
A refund may be issued if:
- purchased tokens were never delivered to the user account,
- the system failed and the user did not receive access to the purchased digital service,
- Stripe processed a transaction in error.
2.3. Unauthorized Transactions
If a payment was made without the user’s authorization, and Stripe confirms that the payment qualifies as fraudulent, a full refund will be issued.
2.4. Token Packages Not Used
Token packages that were purchased but not used at all may be refunded within 7 days from the date of purchase as long as zero tokens have been consumed.
After at least one token is used, the package is considered partially consumed and becomes non-refundable.
3. Non-Refundable Cases
Spayo does not provide refunds in the following situations:
❌ 3.1. “I don’t like the result”
AI-generated images and redesigns are subjective, and quality can vary. Personal preference does not constitute grounds for a refund.
❌ 3.2. Tokens already consumed
Once a token is used for generating an image, that service is considered delivered and cannot be reversed.
❌ 3.3. Misuse of the platform
If the user violates Terms of Service, uses the platform for prohibited content, or attempts to exploit the system, refunds are not provided.
❌ 3.4. Changing your mind
Refunds are not issued simply because the user changed their mind after purchasing tokens.
4. Token Expiration
Purchased tokens currently do not expire unless explicitly stated at checkout.
If token expiration is introduced in the future, users will be notified in advance.
5. Refund Process

To speed up verification, users should include:
- full name
- email used on the platform
- date of purchase
- transaction ID
- description of the issue
Refunds are processed through Stripe and may take 5–10 business days, depending on the user’s bank or card issuer.
6. Chargebacks
Before initiating a credit card chargeback, users must contact Spayo to resolve the issue.
Unauthorized or fraudulent chargebacks may result in:
- suspension of the account
- ban from the platform
- revocation of referral bonuses and free tokens
7. EU, UK, CH, and US Consumer Law Compliance
✔ EU / EEA (GDPR + Consumer Rights Directive)
Digital services delivered immediately after purchase are exempt from the 14-day withdrawal when the user consents to immediate delivery.
By purchasing tokens and using the platform, the user provides such consent.
✔ Switzerland (FADP + Swiss Contract Law)
No mandatory refund right exists for digital goods.
Refunds are at the discretion of the service provider (as outlined above).
✔ United Kingdom (Consumer Rights Act 2015)
Digital services that begin immediately are not subject to withdrawal once consent is given.
✔ United States (FTC, CCPA, CPRA)
Refunds follow the merchant’s written policy as long as it is clearly presented.
This document satisfies those requirements.
8. Modifications
Spayo may update this Refund Policy at any time.
Users will be notified of significant changes via:
- email (if required), or
- a notice on the website.
Continued use of the service after updates constitutes acceptance of the revised policy.
