Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs how users may access and interact with Spayo (https://www.spayo.xyz and https://app.spayo.xyz).

By using Spayo, you agree to comply with this AUP. Violation of this policy may result in account suspension or termination, removal of generated content, revocation of tokens, or reporting to authorities when legally required.

This AUP applies to all users, regardless of country or jurisdiction.

1. General Principles

You may use Spayo only for lawful, safe, and respectful purposes.

By uploading content or using AI tools on Spayo, you confirm that:

  • you have the legal right to use and upload the images,
  • the content does not violate any applicable law,
  • the content does not infringe anyone’s privacy, IP rights, or dignity.

2. Prohibited Content

You may NOT upload, generate, share, or attempt to create any of the following:

2.1. Illegal Content

  • Child sexual abuse material (CSAM) or exploitation of minors
  • Non-consensual intimate images
  • Human trafficking content
  • Terrorism, radicalization, or extremist propaganda
  • Content violating copyright or trademarks
  • Images taken in violation of privacy laws (e.g., hidden cameras)
  • Images of identifiable people uploaded without their permission

Zero tolerance — violations result in immediate account termination and may be reported to relevant authorities (EU, CH, US, etc.).

3. Harmful or Dangerous Content

You may not upload or generate content that includes:

  • Graphic violence, torture, or dismemberment
  • Gore or extremely disturbing imagery
  • Instructions for harming yourself or others
  • Weapons manufacturing or illegal explosives
  • Promotion of self-harm, suicide, or eating disorders

AI image outputs that accidentally generate sensitive or harmful content must be reported via the contact form.

4. Hate, Abuse, Harassment

You may not use Spayo to create, upload, or generate:

  • Hateful content targeting protected classes
  • Discriminatory messages or visuals
  • Threats or harassment of individuals or groups
  • Defamatory or malicious content

Spayo may intervene if the platform is used to target someone maliciously.

5. Sexual Content

Strictly prohibited on Spayo:

  • Nude images or explicit sexual content
  • Images showing minors in any sexualized context
  • Adult content intended for erotic purposes
  • AI-generated explicit content using real people without consent

Non-sexual artistic nudity is not supported — Spayo is not an adult content service.

6. Privacy & Consent

You may NOT upload images of people without their permission if:

  • the image is private, intimate, or confidential
  • the person has a reasonable expectation of privacy
  • you do not have the rights to modify or reproduce the image

Examples of prohibited uploads:

  • Photos of strangers taken without consent
  • Photos of coworkers or private individuals used without permission
  • Images showing identifiable personal data (IDs, documents, etc.)

If you upload images of other people, you are responsible for ensuring you have legal rights to do so.

7. Intellectual Property

You may not upload or generate content that:

  • infringes copyrighted material
  • violates trademarks or publicity rights
  • uses brand logos without permission
  • recreates famous artworks in a misleading or commercial manner
  • replicates images you don’t own (e.g., from Google Images)

You must own the rights to everything you upload to Spayo.

8. Security Restrictions

You may NOT:

  • attempt to bypass security or access other users’ data
  • reverse engineer or interfere with the platform
  • scrape the site (manually or automatically)
  • use bots to create mass accounts
  • attempt to overload servers
  • use Spayo for penetration testing or exploiting vulnerabilities

We reserve the right to block access, throttle abusive activity, or suspend accounts.

9. Spamming & Misuse

Forbidden activities include:

  • creating multiple accounts to receive signup bonuses
  • automated token farming
  • manipulating referral rewards
  • mass-uploading images through bots
  • using Spayo outputs for disinformation, fake news, or impersonation
  • using Spayo for political manipulation or astroturfing

In case of abuse, all promotional tokens may be revoked.

10. AI Limitations & User Responsibility

Spayo generates redesigns using AI. Users agree that:

  • AI results may be imperfect or unpredictable
  • AI outputs may contain inaccuracies
  • AI is not a substitute for human expertise

You are responsible for reviewing and using outputs appropriately.

We do not guarantee suitability for professional, legal, medical, or structural design use.

11. Commercial Use

Spayo allows commercial use as long as you have rights to the input image.

However, you may not use Spayo to:

  • impersonate brands or individuals
  • create misleading product images
  • violate advertising regulations
  • publish deceptive before/after comparisons
  • create content that violates consumer protection laws in your region

If you resell or publish generated content, you are the responsible publisher.

12. Law Enforcement & Compliance

Spayo may suspend accounts, preserve data, or provide information when required by law in:

  • Switzerland (primary jurisdiction)
  • EU (GDPR cooperation)
  • United States (CCPA, CPRA, federal law)
  • Other jurisdictions where legally applicable

We comply with valid legal requests only.

We will never disclose images or personal data voluntarily unless required by law.

13. Violation Consequences

If you violate this AUP, Spayo may:

  • warn you
  • suspend your account
  • terminate your account
  • delete uploaded or generated content
  • revoke tokens and referral bonuses
  • block your IP address
  • notify Stripe or payment partners
  • report illegal content to authorities

No refunds are provided for accounts terminated due to AUP violations.

14. Reporting Abuse

If you see content that violates this AUP, or suspect misuse:

15. Changes to This AUP

Spayo may update this AUP at any time.
Significant changes will be announced on the website.
